Stručný popis předmětu:
The subject matter of the Contract to be awarded within this procedure called "Delivery of neutron optics system for the BEER diffractometer - part I - Round 2" is supply of a detailed technical design and supply of a part of the “Beamline for European Engineering Research” neutron guide system, namely its transport section (hereinafter the "System", where the focusing section is subject to another public contract to be awarded in separate procurement procedure called "Delivery of neutron optics system for the BEER diffractometer - part II- Round 2"). The supply of the System involves necessary research and development activities, delivery of the System to the Contracting Authority at the ESS address in Lund, Kingdom of Sweden, a free licence to use the System for the needs of the Project and its follow-up phases and installation and alignment of the System. The System shall fully comply with all the requirements stipulated in the Contract (including its Annexes). Upon activating a call-in option, the Work under the Contract may be modified to include also additional research and service activities for additional price. The subject matter hereof is further specified in the Tender Documentation comprising, among others, the draft Contract and its Annexes.

  The Contracting Authority is entitled to use the negotiated procedure without publication, in accordance with Sec. 64 letter a) of the Public Procurement Act, since the subject matter of this Public Contract is the supply of System for the purposes of research and development; while the main objective of the Public Contract is to implement the Project as described above. Considering, among others, the quite unusual nature of the Public Contract, the process had required negotiations to take place prior to the commissioning of the first round of the Negotiation Procedure for the Public Contract, and also therefore the negotiated procedure without publication has been the preferred process.
