Brief subject description:
The subject matter hereof is supply of parts of the “Beamline for European Engineering Research” neutron guide system, namely its transport section and focusing section, including, among others, supply of detailed technical designs, delivery of the neutron guide systems, their installation and aligment as well as related activities. The subject matter hereof as well as the relevant public procurement proceedings are divided into two parts (each having its own Tender Documentation) while the transport section is subject to a procedure called "Delivery of neutron optics system for the BEER diffractometer - part I - Round 2" and the focusing section is subject to a procedure called "Delivery of neutron optics system for the BEER diffractometer - part II - Round 2". For more details, please see the information and the Tender Documentation to each of the parts of the Public Contract (see "Lots of public contract" below).

Procedure type, estimated value

• Procedure type: negotiated procedure without prior publication
  Justification of using negotiated procedure:
  The Contracting Authority is entitled to use the negotiated procedure without publication, in accordance with Sec. 64 letter a) of the Public Procurement Act, since the subject matter of this Public Contract is the supply of System for the purposes of research and development; while the main objective of the Public Contract is to implement the Project as described above. Considering, among others, the quite unusual nature of the Public Contract, the process had required negotiations to take place prior to the commissioning of the first round of the Negotiation Procedure for the Public Contract, and also therefore the negotiated procedure without publication has been the preferred process.
